Record Suspension Alberta: Why Seek Expert Help?

A pardon seals your criminal past making it unavailable to any person or entity that may search on the CPIC (Canadian Police Information Centre) to do a background check. A pardon will also seal your information from being accessed by border officials.

However, securing a pardon in Alberta is easier said than done if you don’t have expert help. Why?

  1. Seemingly complex eligibility requirements: First, you need to meet numerous eligibility requirements. For instance, you must adhere to the application eligibility timing (waiting period) applicable to your case.
  2. Error-prone application: You also need to fill out your pardon application completely (without errors) and provide all documentation required (which varies depending on the case). This can be hard if you don’t have expert knowledge.
  3. No assurances: What’s more, the parole board reserves the right to accept/reject applications based on many things including how you address some issues. For instance, you must clearly state how getting a pardon will offer you a measurable benefit as well as help you rehabilitate into society like a law-abiding citizen. This information is required in the measurable benefit/sustained rehabilitation form.

Canada Pardon Application: Getting A Pardon in Alberta

Generally, securing a record suspension on your own is a lengthy 7-step process. Let’s look into the process to understand where experts like us come in:

Step 1: Check Your Criminal Record

You need to visit your local Alberta police service for a criminal record check. When you do your criminal record search, you must ensure it contains all criminal convictions. Missing convictions need to be accompanied by proof of conviction, which may require you to contact the court that handled your case or the police service that handled your arrest.

Step 2: Collecting Court Information

Once you secure your criminal record, you need to get all the court information for all your convictions. You need proof, victim surcharges, compensation, and restitution among other applicable information to provide alongside your pardon application. Individuals with multiple past prison sentences in multiple courts must get information from all courts.

Don’t know where to start when collecting court information? Don’t worry. Talk to us!

Step 3: Alberta Police Record Check

You also need a local police record check for the local area you currently live in. You’ll need local police record checks for other Alberta locations you have lived in over the past 5 years (if you have resided in those places for at least 3 months).

Step 4: Complete Exception Form

This step applies to people who are seeking a pardon and have a record due to a conviction of a Schedule 1 offence (sexual conviction). Such individuals may qualify for a pardon under some circumstances i.e. there was no violence, coercion, or intimidation used when committing the offence. Other special requirements apply.

Not sure how to complete an exception form? Let us help you!

Step 5: Filling and Submitting Record Suspension Application Form

This is a critical step that must be completed truthfully and completely. You also need to provide supporting information.

Step 6: Filling and Submitting the Measurable Benefit/Sustained Rehabilitation Form

As discussed, applicants must also submit a form clearly describing how a pardon would offer a measurable benefit and allow rehabilitation into society as a reputable law-abiding citizen. This form must be filled out completely with supporting information attached.

Step 7: Paying the Application Processing Fee and Submitting the Application

Lastly, you must pay processing fees ($50 Canadian Dollars) or your application won’t be processed. Before submitting everything, you need to ensure you have completed all steps as required.

Disclaimer: The above information is an oversimplification of the process of securing Alberta pardons. There are many other factors to consider. For instance, past/current members of the Armed Forces (Regular or Reserve Canadian Army members) must follow additional steps like getting a military conduct sheet and ensuring it contains all the required information and is signed by the relevant persons i.e. your commanding officer. Some additional information may be needed, such as copies of identity documents.

Getting a pardon in Alberta can obviously be an overwhelming process which is why you need experts like us! Don’t attempt it on your own unless you understand the process and requirements perfectly.
